Descripción editorial
This appeal is from the 30 September 1986 decision of the United States Patent and Trademark Office (PTO) Trademark Trial and Appeal Board (board), 1 U.S.P.Q.2D (BNA) 1296, affirming the refusal by the Trademark Examining Attorney to register the mark VITTEL and bottle design for enumerated cosmetic products on the application of Societe Generale Des Eaux Minerales De Vittel, S.A. (Vittel), serial No. 398,038, filed 30 September 1982. Refusal to register was under section 2(e)(2) of the Lanham Act (15 USC 1052(e)(2)) on the ground that the mark is "primarily geographically descriptive" of the goods. We reverse.
