Where evidence of driver's alcohol intake merited jury instructions on statute prohibiting driving under the influence of alcohol, a new trial on liability was warranted by trial court's failure to read the statute and by the lack of evidence to support the verdict finding neither party negligent. FOLEY, Judge Ronald Kirsebom was injured after his motorcycle collided with the automobile of Daniel Connelly. Kirsebom sued Connelly for negligence.
