Wallace-Ingram v. office of Personnel Management

Sandra v. Wallace-Ingram, Tina L. Eddins, and Wade D. Wallace, Jr. petition for review of the October 3, 1997 decision of the Merit Systems Protection Board ("Board"), Docket Nos. DC-0831-96-1009-I-1, DC-0831-96-1021-I-1, & DC-0831-96-1039-I-1. Petitioners appeal the Boards affirmance of the Office of Personnel Management ("OPM") reconsideration decision denying their application for the lump-sum death benefits of their mother. Because the Board erred in concluding that the waiver by Mr. Wallace, Sr., of his survivor rights was ineffective in terminating his rights to a spousal survivor annuity, we reverse and remand.
