Appellant Edgar Randolph Hughes, Jr., pleaded guilty to aggravated robbery and was sentenced to 240 months, which was an
upward departure from the presumptive sentence; he was also ordered to pay restitution, the amount of which was determined
by Community Corrections, subject to Hughes?s right to a hearing. Between the date Hughes received his executed
sentence and the date the amount of restitution was determined, the United States Supreme Court decided Blakely v. Washington,
542 U.S. 296 (2004).
