Order AMENDING OPINION AND GRANTING MOTION TO PUBLISH OPINION IN PART WHEREAS, upon a motion by the appellant, the court believes the opinion in this matter should be published in part; and WHEREAS, in order to facilitate the partial publication of the opinion, it is necessary to rearrange portions of it; it is now Ordered that the opinion shall be amended to move Section II to page 6, line 3. The remaining content of the opinion shall remain unchanged; and it is further Ordered that pages 1 through the end of Section II on page 7 of the opinion shall be published in part as set forth in the amended opinion.
