On January 11, 2002, President Bush signed the Small Business Liability Relief and Brownfields Revitalization Act (the Act) into law. The Act amends the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), (1) also known as the "Superfund Law," in a number of significant ways that may affect purchasers in certain real property transactions. This article will highlight certain aspects of the Act and will discuss how some of the Act's provisions may raise new issues of concern about which purchasers of real property should be aware.
