Order unanimously modified by providing that plaintiffs motion is granted to the extent of awarding plaintiff partial summary judgment on its cause of action for an account stated, insofar as based on the invoices dated August 9, 2001 and October 12, 2001, and matter remanded to the court below for further proceedings on the remainder of the account stated cause of action and on the breach of contract cause of action; as so modified, affirmed without costs.
