A typical illustration of our failed professional liability ("medical malpractice") insurance system is a woman in poor health who loses her baby in childbirth, and who hires an attorney on a contingency fee basis to sue her obstetrician. On the witness stand, the grieving mother's testimony is given between sobs, repeatedly interrupted to allow her to regain her composure, as she tells a sympathetic jury how much she loved her baby and how the loss of her baby has devastated her.
