The record does not disclose a contract between plaintiff and defendant for the special charter of an airplane to take plaintiff from Minneapolis to Rochester, and in consequence there may be no recovery by him for injuries received in an emergency landing made by a plane owned and operated by another company, in which plaintiff undertook the flight.
