Psychopathic personality -- conflict in evidence as to existence thereof. 1. Where the evidence as to the existence of a psychopathic personality as defined by Minn. St. 1941, § 526.09 (Mason St. 1940 Supp. § 8992-184a), is in conflict, the question is one of fact to be determined by the trial court upon all the evidence.
