[U] In Re Estate Of Solochek

¶1. Joseph R. Kabacinski appeals from an order dismissing his claim against the Estate of Joe Solochek. Kabacinski claims the trial court erred when it: (1) ruled that the Estate's objection to Kabacinski's first claim satisfied Wis. Stat. § 859.33 (1999-2000)*fn1 and applied to any subsequent amended or new claim; and (2) directed a verdict on the basis that there was no evidence to sustain his claims. Because the trial court did not err with respect to the first issue, we affirm that decision; however, we conclude that the trial court erred in directing a verdict. Accordingly, we reverse and remand for further proceedings consistent with this opinion.
