Publisher Description

SILER, Circuit Judge. Defendant Milo G. Ayen appeals the denial of his pretrial motion to suppress evidence. He entered a conditional plea of guilty to the charge of manufacturing marijuana, in violation of 21 U.S.C. § 841 (a)(1), reserving the right to appeal, under Fed. R. Crim. P. 11(a)(2). The issue is whether evidence should have been suppressed due to false statements in the affidavit upon which the search warrant was based. For the reasons herein, we AFFIRM the order by the district court.
