This is a direct appeal from a jury conviction in June of 1973 on a two-count indictment of threatening a federal witness in violation of 18 U.S.C. § 1503 (1968). The District Court imposed a maximum sentence by fining the defendant-appellant Baker the sum of $5,000 on each count and imposing a 5-year imprisonment term on each count. The prison term on the second count was suspended and Baker was ordered to be placed on probation for a period of five years following the expiration of the sentence on the first count.
