Publisher Description

BOGGS, Circuit Judge. Alan Louis Bashara was charged in a two-count indictment for his role in a drug conspiracy that also involved money laundering. Five days before his trial was to begin, Bashara pleaded guilty to both counts. However, eight days before his sentencing, he moved to withdraw his plea. The court rejected his motion and sentenced him to a 97-month prison term, followed by five years supervised release. Bashara appeals from his conviction and sentence, claiming that he should have been permitted to withdraw his plea, that he was not properly notified by the court that he would face a mandatory minimum sentence for one of the crimes to which he pleaded guilty, and that the court improperly calculated his total offense level under the sentencing guidelines. For the reasons set forth below, we affirm.
