Per Curiam. Defendant-appellant Calvin Lee Cross appeals his conviction on six charges of bank robbery and aiding and abetting to which he entered a conditional plea of guilty. Cross contends that the district court should have suppressed certain statements made by him to an FBI agent while he was in state custody on an unrelated charge. For the reasons below, we affirm in part, reverse in part, vacate defendant's conviction, and remand for further proceedings consistent with this opinion.
