On July 21, 1987, a grand jury of the United States District Court for the Eastern District of Michigan returned a secret indictment charging W. Otis Culpepper (Culpepper) with one count of evading the payment of income taxes for the years 1978 and 1980, in violation of 26 U.S.C. § 7201, three additional separate counts for failure to file and pay income taxes for the years 1981, 1982, and 1983, respectively, in violation of 26 U.S.C. § 7201, and a fifth count charging him and a co-defendant, Milton David Jones (Jones), a purported member of a narcotics enterprise known as the Young Boys, Inc., with conspiring to defraud the United States by concealing assets in violation of 18 U.S.C. § 371.
