United States v. Cutright

Johnnie Dale Cutright pled guilty to one count of possession of a firearm by a convicted felon in violation of 18 U.S.C. § 922(g)(1) (1994). The United States appeals the district courts decision to depart below the Sentencing Guidelines range. We affirm the conviction, but vacate the sentence and remand for further proceedings consistent with this opinion.
