Publisher Description
Defendant-Appellant Rex A. Deitz appeals his conviction by a jury for conspiracy to possess and distribute more than 50 grams but less than 500 grams of methamphetamine under 21 U.S.C. §§ 841(a)(1), 841(b)(1)(B), and 846. He also challenges his corresponding 144-month sentence. Deitzs conviction and sentence arise from his involvement with the Outlaw Motorcycle Club ("OMC" or "Outlaws"), an international motorcycle club with chapters nationwide and abroad. Following a large-scale investigation, Deitz and thirty-seven co-defendants were indicted for an alleged widespread conspiracy involving violations of the Racketeer Influenced Corrupt Practices Act ("RICO"), 18 U.S.C. § 1961, et seq., and various narcotics and firearms laws. Deitz asserts that his conviction is not supported by sufficient evidence, numerous other instances of trial error and prosecutorial misconduct violated his constitutional rights, the district courts decision to empanel an anonymous jury was an abuse of discretion, and his 144-month sentence is unreasonable. For the following reasons, we AFFIRM the judgment of conviction and sentence imposed by the district court.
