THIS case was brought up, by writ of error, from the Circuit Court of the United States for the Southern District of New York. It was a suit brought by John Caswell and Solomon T. Caswell, merchants of New York, against Lawrence, the collector, to recover an excess of duties upon brandy, paid under protest. The whole case is set forth in the bill of exceptions, which was as follows:
