Martinez was convicted of robbery in 2004 and assessed costs of $308.00. In 2006, the trial court signed an order authorizing the Texas Department of Criminal Justice-Institutional Division to make payment to the McLennan County District Clerk out of Martinezs inmate trust account of $7,317.47. Martinez filed an appealand a petition for writ of mandamus. We requested a response, which was filed on behalf of the Respondent.
