FANSLER, J. The appellees decedent was killed when the gasoline truck which he was driving was struck by appellants train at a grade crossing in the town of Jamestown in Boone County. This is an action for damages alleged to have been caused by the negligent conduct of appellant in the operation of its train. There was judgment for the plaintiff.
