Stephen J. Smith v. Atco Co‪.‬

Action by the plaintiff Stephen J. Smith against the defendants Atco Company (hereinafter referred to as Atco) and Delta Oil Products Company (hereinafter referred to as Delta) to recover damages for death and injury to mink alleged to have been caused by the mink coming in contact with a wood preservative known as Penta-Mix. Delta is the manufacturer of Penta-Mix and Atco is the selling agent thereof. No privity of contract existed between the plaintiff and the defendants.
