Publisher Description
In this appeal, we are asked whether conviction in the District Court of Maryland for violation of Md. Ann. Code art. 66 1/2, § 4-102 (a) (Driving a motor vehicle without the consent of the owner) precludes a subsequent conviction for violation of Md. Ann. Code art. 27, § 349 (Unauthorized use of a vehicle), when both charges arose from the same occurrence. We conclude that the second trial was not barred by the doctrine of double jeopardy, and we hereinafter state our reasons.
