1 This is an appeal from the Superior Court of Comanche County, wherein on January 31, 1963 a jury returned a verdict finding the plaintiff in error, hereinafter referred to as defendant, guilty of burglary in the second degree, and fixed his punishment at four years in the State Penitentiary.
