Application for two policies on decedents life was made with defendants agent, one Yoswa; however, the company rejected the application based on decedents medical history. The company was willing to issue a policy at roughly twice the normal premium on a cash, rather than financed, basis, so two policy forms were sent to Yoswa, one for $50,000 and one for $75,000, both set up for a cash sale. Realizing that decedent could not afford the increased premium in full, Yoswa obtained the companys commitment to accept premium financing with a greater down payment.
