1 This appeal involves an action, brought by the defendants in error, hereinafter called the plaintiffs, against the plaintiff in error, hereinafter called the city, for damages allegedly resulting from raw sewage having backed up into the plaintiffs home from the citys sanitary sewer main through the sewer pipe connecting the plaintiffs home to such sewer main. Insofar as pertinent herein, the plaintiffs amended petition alleges:
