Plaintiff, a medical provider, instituted this action to recover first party no-fault benefits from Defendant insurer. Defendant moved for summary judgment, alleging that Plaintiff had originally submitted the claim to the American Arbitration Associations No-Fault Tribunal, and therefore the present action is barred.
