Publisher Description

Plaintiff entered a dimly lighted office building lobby for the purpose of going to the sixth floor after elevator service had terminated for the night. Discovering the door to the elevator shaft partly open, he opened it farther and stepped into the shaft without attempting to ascertain whether the elevator car was at that floor and was injured. His conduct held negligent as a matter of law and not excused by reliance on a custom of leaving the shaft door ajar when the car was at that floor.
