This case originated in the Circuit Court in and for Duval County. The action is one for damages for personal injuries. The complaint charged that Bartholf was guilty of negligence in that he failed to provide for Baker a reasonably safe place in which to work. Answer was filed which denied the asseverated negligence and presented defenses (with are affirmative in character) of assumption of risk and contributory negligence. Consequent upon the jurys verdict in favor of Baker the court entered judgment in the sum of $20,000 against Bartholf. This appeal ensued.
