Publisher Description
1 This case presents us with an opportunity to harmonize the procedural standards governing summary judgment with the substantive standards for determining which partys understanding should prevail in a dispute over the meaning of a contractual term. We hold that, in the present case, the Plaintiffs failed to eliminate genuine issues of material fact bearing upon which partys interpretation should control. We therefore reverse the grant of summary judgment in Plaintiffs favor.
