HOLLAND, Justice: The defendant, George T. Atkins, was indicted for Delivery of Cocaine and Conspiracy Second Degree. A codefendant, John Brokenbrough was indicted for Delivery of Cocaine. In addition, Mary Scott, a second codefendant, was indicted for Delivery of Cocaine and other related offenses. Scott later pled guilty to reduced charges. After Atkin's motion to sever his trial from Brokenbrough's trial was denied, Scott, pursuant to her plea agreement, testified as a witness for the State at the joint trial of Atkins and Brokenbrough. During the trial, Brokenbrough presented an alibi defense while Atkins alleged entrapment as his defense. Following a jury trial in the Superior Court in Kent County, both defendants were convicted as charged.
