1. When the trial Judge in a bench trial suggests that he will allow testimony from all witnesses about transactions with a person who has died before trial, even though that testimony would be barred by the Dead Mans Statute, W.Va. Code, 57-3-1 [1937], and all parties agree to the arrangement, there is no reversible error in admitting such testimony.
