We granted the writ of error in this case to decide whether the Presbyterian Children's Home and Service Agency ("the Agency") is a religious corporation exempted from the general prohibition of discriminatory hiring practices contained in the Texas Commission on Human Rights Act ("the Act").*fn1 TEX. REV. CIV. STAT. art. 5221k § 5.01 (Vernon 1987).*fn2 However, at oral argument the Agency urged us to dismiss this case as moot, arguing that no live controversy exists between it and Speer. We agree. Accordingly, without reference to the merits, we vacate the judgment of the court of appeals and of the trial court, and dismiss this case as moot. See Guajardo v. Alamo Lumber Co., 159 Tex. 225, 317 S.W.2d 725, 726 (Tex. 1958).
