His sister, as guardian ad litem, filed this diversity action against Public Service Company of North Carolina ("Public Service") alleging negligence and seeking damages for Lindsay's injuries.*fn1 At trial, the district court granted Public Service's motion for a directed verdict at the close of plaintiff's case and plaintiff appealed.
