James Lindsay suffered permanent paralysis and brain damage from inhaling carbon monoxide fumes produced by a motel room gas heater. His sister, as guardian ad litem, filed this diversity action against Public Service Company of North Carolina ("Public Service") alleging negligence and seeking damages for Lindsay's injuries.*fn1 At trial, the district court granted Public Service's motion for a directed verdict at the close of plaintiff's case and plaintiff appealed. Finding no error, we affirm.*fn2
