Publisher Description

RIPPLE, Circuit Judge. Louis W. Valbert filed this medical malpractice suit against Dr. James H. Pass, seeking $500,000 in damages for injuries suffered as the result of the amputation of his right lower leg. The jurisdiction of the district court was based on diversity of citizenship under 28 U.S.C. § 1332. Dr. Pass requested a jury trial, and the jury returned a verdict in his favor. The district court denied Mr. Valbert's motion for a new trial. We affirm the judgment of the district court.
