Defendant was not denied a fair trial by admission of other-crime evidence pursuant to Minn. R. Evid. 404(b), and State v. Spreigl, 272 Minn. 488, 139 N.W.2d 167 (1965), or by trial court's instructions on reasonable doubt, but defendant is entitled to have a conviction for second-degree intentional murder vacated pursuant to Minn. Stat. § 609.04 since it is a lesser-included offense of first-degree premeditated murder, of which defendant was also convicted on the basis of the same act.
