Two actions for wrongful death, in the district court for Steele county, consolidated for trial and heard together on appeal, one by Albert Schroht, as trustee for the next of kin of Marlowe E. Schroht, and one by Erick F. Eschenbach, as trustee for the next of kin of Harold E. Lewison. Both of the deceased were killed in a collision between a train of defendant Chicago & Northwestern Railway Company and a truck owned and operated by Arnold Voll, whose administrator, Leona Voll, was named as defendant. The cases were tried before Axel B. Anderson, Judge, and a jury, which returned a verdict for plaintiff for $17,500 in each action. The defendant railroad appealed from an order in each action denying its alternative motion for judgment or a new trial and from an order in the first action denying defendant Volls alternative motion for a reduction in the verdict or new trial.
