SEAWELL, J. This appeal is from a judgment rendered against plaintiff, as the administrator of the estate of Rose Carauddo, deceased, and in favor of defendant, Dr. Fred S. Ryan. The action originally included as defendant the members of the board of supervisors of Santa Clara County in their individual and official capacities, and Dr. Doxey R.
