Appellant, Jody Frank Miller ("Defendant" herein) was convicted after a jury trial on three counts of statutory sodomy in the second degree, in violation of Section 566.064, and was sentenced to five years on each count; Counts I and II to run consecutively and Count II to run concurrently to the sentences in Counts I and II.
