This is an appeal from an order entered June 15, 1968, denying the defendant-appellant, Payne & Dolan's motion for summary
judgment. The action is for damages from personal injuries caused by a fall on a bituminous surfaced walkway in the Milwaukee
County Zoo on August 8, 1965. The plaintiff claims his fall was caused by a defect in the walkway. The claimed defect consists of a depression in the walkway
in the shape of a "soup dish" which collected water and mud. It is claimed this condition constituted a hazard to the plaintiff
as a frequenter of the zoo, and that plaintiff fell while on his way to a zoo building.
