Daly V. Lynch

This is a negligence action in which plaintiffs brought suit to recover damages for the injury sustained by the plaintiff-wife while a guest in the home of the defendants. The jury entered a verdict for the defendants and the plaintiffs appeal. Three issues are raised by plaintiffs on appeal: (1) whether the trial court properly instructed the jury on the standard of care owed to a licensee by a possessor of land; (2) whether the trial court erred in refusing to give an additional instruction defining proximate cause after the jurors had begun to deliberate; and (3) whether the trial court erred in denying plaintiffs' motion for a new trial.
