1. A real estate mortgage is under our statute (2 Mason Minn. St. 1927, ? 9572) not to be deemed a conveyance so as to enable the owner of the mortgage to recover possession of the property without foreclosure. But, subsequent to the execution of the mortgage, the mortgagor may assign rents to the mortgagee to be applied on the mortgage debt, and incidentally authorize the mortgagee to take possession for the purpose of leasing the property and collecting the rents.
