In re Moreland

SILER, Circuit Judge. Appellant Resolution Trust Corporation ("RTC") appeals the district courts decision affirming the bankruptcy courts decision granting Appellee-Debtor Ethelrine Morelands motion to avoid a judicial lien. The RTC claims that: (1) the district court improperly based its decision on issues raised by neither the parties briefs nor the bankruptcy court; and (2) the district court should have reversed the decision of the bankruptcy court and denied Morelands motion.
