En 2002, en rendant sa decision dans l'affaire Spar Aerospace Itee c. American Mobile Satellite Corp., la Cour supreme du Canada ratait une occasion d'arrimer les regles de droit international prive canadiennes et quebecoises. Pour rauteure, la decision cree une asymetrie sur trois plans: d'abord, la Cour relegue les principes de courtoisie, d'ordre et d'equite au rang de guides d'interpretation ; ensuite, elle refuse de tenir compte du test du lien reel et substantiel comme critere additionnel aux criteres specifiquement codifies au Code civil du Quebec ; enfin, elle ne se penche pas assez longuement sur le test du forum non conveniens et insiste trop sur son caractere exceptionnel. Par un examen de la jurisprudence canadienne et des dispositions du Livre dixieme du Code civil, l'auteure avance qu'il n'existe que peu de raisons justifiant le maintien d'un droit international prive quebecois isole du droit canadien et de son evolution recente. In 2002, in rendering its judgement in the case of Spar Aerospace Ltd. v. American Mobile Satellite Corp., the Supreme Court of Canada missed an opportunity to bring together Canada and Quebec's private international law rules. According to the author, the decision creates a triple asymmetry: first, the Court relegates the principles of courtesy, order, and equity to the rank of interpretative guidelines; second, it refuses to recognize the real and substantial connection test as an additional criterion to those specifically codified in the Civil Code of Quebec; third, it fails to sufficiently consider the forum non conveniens test and excessively stresses its exceptional character. Through an examination of Canadian jurisprudence and the provisions of Book Ten of the Civil Code, the author argues that few reasons justify maintaining Quebec international private law rules isolated from Canadian law and its recent developments.
