Taylor v. Thomas

After stating that a system
of rules had been permitted to grow up with respect to mining on the public lands by the voluntary action and assent of the
population, whose free and unrestrained occupation of the mineral region had been tacitly assented to by the Federal government,
and heartily encouraged by the expressed legislative policy of the State, the court said.
