1 James Vernon Vassar was charged in the district court of Tulsa County with the crime of second degree burglary, after former conviction of a felony, was tried before a jury and convicted, but the jury being unable to agree upon the punishment, left that to the court. The court assessed the penalty at confinement in the State Penitentiary for a term of twenty-five years, and a fine of $200. The case is here on appeal, and the complete record has been furnished at the expense of the county.
