Publisher Description
Appellant Ramon Evan Bland appeals two convictions of second degree assault. Specifically, he contends that (1) he was denied his right to a unanimous jury, (2) there was insufficient evidence to support the alternative means of committing assault for counts 1 and 2, (3) there was insufficient evidence to find assault of the second victim for count 2, (4) the convictions for counts 1, 2, and 3 violate the constitutional prohibition against double jeopardy, and (5) counts 2 and 3 merged because they were based on the same victims. We affirm as to count 1, reverse and remand for a new trial as to count 2, and reject Bland's double jeopardy and merger claims.*fn1
