In this appeal, Donald Gene Booth presents two claims of error from his conviction for first degree robbery. First, Booth contends an eyewitness identification admitted at trial was improperly made and should have been suppressed. Second, he claims prejudicial error as a result of certain statements made by the bailiff to the jurors during deliberations. We find that the bailiffs statements resulted in prejudicial error and therefore reverse and remand for new trial.
