The State, in its appeal from the trial courts order suppressing Robert W. Bryans statements to police and his confession of taking a motor vehicle without permission, is cast in the unusual position of arguing the lack of evidence to support probable cause for arrest. At issue is whether the police had probable cause to arrest the defendant at the time of police interrogation, thus requiring Miranda warnings before defendants incriminating statements and later confession could be used against him. We affirm.
