The opinion of the court was delivered by This appeal arises from a denial by the district court of Lincoln county of a motion filed by the petitioner, Thomas E. Baier, pursuant to the provisions of K.S.A. 60-1507. On February 5, 1964, a complaint was filed in Lincoln county court charging petitioner with forgery in the second degree (G.S. 1949, 21-608, now K.S.A. 21-608) and a warrant was issued for his arrest.
